Our agreement.

Pure Design Projects is a sole-trader stonemasonry studio operated by Ivan, established 2004, based in Tottenham VIC, Australia. ABN [ABN to be inserted]. References to "we", "us" or "our" in these terms refer to Pure Design Projects. References to "you" refer to the customer placing the order.

By placing an order through this site you confirm that you are at least 18 years of age, are ordering for lawful personal or business purposes, and accept these terms. If you do not accept these terms please do not place an order.

An order is only accepted once we issue an order confirmation email. Until that point, no contract is formed and we reserve the right to decline an order — for example if a product is mispriced, out of stock, or cannot be delivered to your address.

All prices are shown in Australian dollars (AUD) and are GST inclusive where GST applies. Goods and Services Tax of 10% is included in the displayed price for Australian consumers.

Payment is processed through Stripe. We accept the major cards that Stripe supports. By submitting an order you authorise us, via Stripe, to charge your nominated payment method the total amount shown at checkout.

We do not store your card number — Stripe handles card capture under PCI-DSS. Stripe's terms apply to its handling of your payment data.

Promotional codes, if any, must be entered at checkout. One promo code applies per order. Codes are not redeemable for cash and may be withdrawn or suspended at our discretion.

We currently ship within Australia only. Physical, parcel-sized goods are dispatched via Australia Post (AusPost). Larger items, slabs and installed work are handled by our own crew or a freight partner, by quote.

Production lead time for stock items is typically 7 – 14 business days before dispatch. Bespoke commissions, fireplaces, benches and made-to-order pieces sit on a longer lead time, which we confirm in writing before you pay.

Delivery times once dispatched depend on the carrier and your address. We share tracking details by email when your order ships. We are not responsible for delays caused by the carrier, weather or events outside our control, though we will help you chase them down.

Title in the goods passes to you when we have received cleared payment in full.

Risk in the goods (i.e. responsibility for loss or damage) passes to you when the goods are handed to the carrier or, for in-person installs, when our crew completes the install and you sign off.

You must inspect goods on receipt and notify us promptly of any damage in transit — see our Returns & Refunds page.

Stock items: if your order has not yet shipped, contact us and we will cancel and refund in full. Once dispatched, the return process described in our Returns & Refunds page applies.

Bespoke & made-to-order: once we have begun cutting or fabricating, custom pieces cannot be cancelled. Where a custom order is cancelled before work begins, deposits may be retained to cover design and quoting time. Specific terms will be set out in the project quote.

All photographs, drawings, renderings, designs and written content on this site are the intellectual property of Pure Design Projects (or licensed to us) and are protected by Australian copyright law. You may not copy, reproduce or commercially use this material without our written permission.

Designs we develop for custom commissions remain our intellectual property unless a separate written agreement specifies otherwise. Photographs of finished commissions may be used in our portfolio, on social media and on this site, unless you ask us not to.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

To the maximum extent permitted by law, and subject to the non-excludable rights above, our total liability for any claim arising out of your purchase is limited, at our option, to:

• replacement of the goods, or supply of equivalent goods;
• repair of the goods; or
• refund of the price paid for the goods.

We are not liable for indirect, consequential or special loss (including loss of profits, business or opportunity), or for damage caused by misuse, accident, or third-party installation outside our control.

Natural stone varies between blocks and between slabs cut from the same block. Veining, colour, density and surface texture will differ from the photographs shown on the site, which are representative only. This is part of the material's character and is not a defect.

For bespoke commissions where vein-matching matters, we will walk the slab with you (in person or by video) and confirm selection in writing before cutting.

These terms are governed by the laws of the State of Victoria, Australia. Any dispute will be dealt with in the courts of Victoria, subject to your non-excludable rights under the Australian Consumer Law.

We may update these terms from time to time — for example to reflect changes in the law or in how we do business. The version that applies to your order is the version published on this site at the time you placed it. Material changes will be flagged with a new "Last updated" date.
